Background Checks

Background checks aren’t mandatory in Israel, but are common practice. Before conducting a background check, an employer must obtain consent and inform the employee of the following:

  • The purpose of the information requested

  • How will the information be shared and processed

  • Whether there is a legal obligation for the background check or if it’s voluntary

The following restrictions apply when conducting background checks:

  • Employers are prohibited from verifying data that may result in discriminatory treatment such as age, race, gender, religious or political beliefs, union memberships, sexual orientation, medical history, and more

  • Employers are prohibited from conducting criminal background checks except for employees who work with children or people with developmental disabilities

  • Employers must obtain consent if they use a third-party service to conduct background checks
